The practice area
Mr. Hua specializes in legal issues related to the Internet and the High and New Technology Enterprises. He works acts as legal advisors of enterprises, and in specific areas such intellectual property protection, antitrust laws, enterprise restructuring, acquisitions, restructuring, financing and investment, and in litigation and arbitration of economic disputes.
Mr. Hua is among the earliest Chinese lawyers researching the legal issues pertaining to the Internet and high technology enterprise. For a prolonged period he was the only reserved columnist for Beijing Youth Daily, Dazhong Computer Daily and the legal column of the Central People’s Radio Station, and has published over a hundred pieces of articles. Mr. Hua succeeded in handling the case regarding mp3 information network broadcasting rights between Baidu and 7 major records companies, the Copyright and Antitrust case between Baidu and 3721 Company, the Copyright and Antitrust case between Baidu and 8848 Company, the first internet transaction dispute case in China, and the first case regarding the spreading of pornographic materials through a website (Hua Ao Forum), China’s first IP case regarding breach of copyright of blogs, etc. These cases have great impacts on the IT industry and the general public.
Mr. Hua’s clients include www.baidu.com (the world’s largest Chinese search engine), China Construction Bank, China Xinda Asset Management Company, China Chemicals Import and Export Co., Ltd, Dapeng Asset Management Co., Ltd, Changchun Film Studios, BIT Technology Holding Co., Ltd (a listed company in the Shenzhen Stock Exchange), China Ping An Insurance Co., Ltd Beijing Branch, Beijing Guanglianda Huizhong Software Technology Co., Ltd (China’s largest construction accounting software manufacturer. These are all well-known enterprises locally or overseas.
Up to now, Mr. Hua has been Baidu’s only permanent legal advisor since its establishment in 2000. As Baidu does not have its own legal department, he is fully responsible for Baidu’s legal affairs, including Baidu’s listing process in NASDAQ. He has provided quality legal services for the development of Baidu, helping Baidu to grow from a 7-people company at its establishment to become a globally renowned internet enterprise with the highest market value in China.
Mr. Hua worked for Jiangxi Copper Co., Ltd (one of the 500 strongest enterprises in China), Zhongshan Securities and Nanfang Securities, as manager of the IT Department. Later he practiced law in Beijing Jianyuan Law Firm and Beijing Jinping Law Firm, during which he was admitted as partner. In March 2006 Mr. Hua joined Guo & Partners as senior partner.
Mr. Hua Jianming graduated from North China University of Technology with Bachelor of Engineering and obtained LL.B from China University of Politics and Law and LL.M from Renmin University of China. He is fluent in English.
Mr. Hua is the academician of China Law Association and the Chinese National Lawyers Association, member of the E-business Committee of Beijing Lawyers Association and the specialist of China Intellectual Property Society.
